Resumen: In Judgment 58/2001. (XII.7.) AB1 the Hungarian Constitutional Court ruled on the matter of eight (unified) petitions. As the petitions raised the examination a number of layers of constitutional problems relating to the right to names, it should be instructive to scrutinize the conceptual and theoretical basics concealed beneath these matters. As the Judgment presenting this case, I am all the more glad to do this inasmuch as I believe the issues surfacing through this case cover interesting interrelationships of constitutional law for the other modern European constitutional states (including Spain, celebrated in this volume). |
Sumario: 1. Circumstances warranting attention in the examination of the right to names. Social determination of the right to names – the limits of the state’s regulatory competence
2. The Constitutional Court’s rulings on the petitions |
