Resumen: The constitutional judiciary in the Slovak Republic represents a concentrated and specialized model of the protection of constitutionality. It is represented by the Constitutional Court of the Slovak Republic (hereinafter “Constitutional Court”) which is independent constitutional authority of the judicial type. The Constitutional Court has the same position as other highest constitutional authorities of the Slovak Republic established by the Constitution of the Slovak Republic (Constitutional Act No. 460/1992 of the Collection as amended –hereinafter “Constitution”). To proceedings before the Constitutional Court the enumerative principle is applied which means that the power of the Constitutional Court should be applied only in proceedings which are expressly regulated and predicted in the Constitution and Act No. 38/1993 Collection of Laws on the Organisation of the Constitutional Court of the Slovak Republic, Proceedings before the Court and the Status of its Judges as amended (hereinafter “Act of the Constitutional Court”). |
