Resumen: In June of 2002 I have been honoured by Professor Francisco Fernández Segado. Professor Segado invited me to literal participation at the project devoted to the 25th anniversary of adoption of the Spanish Constitution. Perhaps being too excited by the offer I have forgotten to ask him whether I am required to write on the Spanish Constitution, or on any constitutional law issue. Later, after accepting the offer, I have realized that writing on the Spanish Constitution would mean an act of imprudence from me as I am not an expert in the Spanish constitutional law in fact. Due to it I have written the following comparative contribution on more universal issues concerning the judiciary and the judges. I can only hope that my writing on this topic did not result into another act of impudence. |
Sumario: Foreword.- Introduction to the topic.- 1. Protecting the judiciary and the judges. A) Independence of judiciary and judges. a) Non-accountability principle. b) Other guarantees of independence. B) Division of powers and separation of the judiciary and the judges. C) Guarantees of income. D) Certainity about keeping the position. E) Immunity of judges. F) Other guarantees.- 2. Protection from the bad behaviour of the judges. A) Qualities of judges. B) Judicial Councils.- 3. Conclusions |
